Has taken One-Turn or Two-Turns Penalty under RRS 44.2
Brief description of the incident (place, time, involved boats, infringed rule):
During the approach to Mark 2, while preparing to gybe, I was the windward boat on port tack, and a starboard-tack leeward boat (221858 NED) was crossing ahead of me. I believed that I was crossing in front safely, but I could not be entirely certain that I had not broken a rule — in particular, RRS 10 (On Opposite Tacks).
Therefore, acting in good faith and in accordance with RRS 44.1, I chose to exonerate myself by performing a Two-Turns Penalty (720°).Due to the fact that the Blue fleet was converging at Mark 2, and I was on the second upwind leg heading to the final downwind, I waited only long enough to ensure safety and avoid interfering with nearby boats. I then immediately executed the penalty turn just above Mark 2, after slightly separating myself from the fleet traffic.
My penalty was executed, promptly, as required by RRS 44.1,in a safe location, to avoid obstructing other boats,without gaining advantage or affecting the fairness of the race.I respectfully submit this declaration for consideration in the protest hearing.
